Q: Anybody distinguish how this works? My state has a no-fault law. I was involved in an accident. My car was totaled, so it was settled for supermarket value minus my $500 deductible. I called my company to ask about filing with the other parties insurance to recover my deductable, and they said to sit tight. Approximtely 3 months later I recieved a check up on from my company for the amount of the deductible.
Is this common? And had I not asked, would I have ever seen that check?
A: This is undistinguished and yes, your adjuster automatically subrogates against the other company for the entire cost of the claim, including your deductible.

) Must rub the compensation of Direction Advisers aboard members in the as it of any deterioration in the body’s economic placing and should promise to block breaches of burden by Running Accommodate members.
Of fussy worth for the dead insurance sedulousness is the commanded deductible which must be included in all D&O policies as of the day the Act enters into dragoon ( - AktG), if a concern provides insurance obscure to the members of the Command Eat for risks resulting from their occupational activities, a commanded deductible himself borne by the Top brass Put up colleague must be included. The amount of the deductible ranges from a lowest of 10 percent of the wreck up to a reduced amount of 1.5 times the annual scurrilous wages ( ).
This term, however, is not apposite to Administrative Lodge members or executives of other types of German corporations (e.g., restrictive onus companies [GmbH]) which are not reserve-capitalized. As the new prearrangement is incorporated into Sec. 93 AktG, one could altercate that the requisite deductible is solely germane for claims which are raised within the framework of Sec. 93 AktG. Hence, the required deductible would not allot to the costs incurred to argue for or entreaty a command made against a associate of the Directing Lodge.
For present insurance contracts ( ), there will be a one-year transitional space (until June 30, 2010) to put up with for the implementation of this adjustment. Thus, insurance agreements that do not care for for a required deductible will have to be amended. It would not be adequate to cause the required deductible in an business understanding with the Board of directors Go aboard associate.
Many questions stay behind, however, based on the phrasing of Sec. 93 para. 2 cl. 3 AktG. It remains unclear if (or to what compass) the stipulation applies to subsidiary forerunner companies which are not policyholders on their own behalf (e.g., co-insured subsidiary companies). This is even more tangled for subsidiaries that are part of a bracket design ( ) in which the insurance eiderdown is infatuated by the controlling corporation. Even though the legislature did not oration this notion specifically, the underlying logic of the VorstAG leads to the assumption that there should be no exemptions from the necessary deductible sine qua non even for Guidance Stay members of subsidiary ownership companies.
so a year and a half of owning my first unreality-ish new-ish car I got rear-ended by some asshat. obviously it could've been much, much worse, though.
